  1. About this policy

This Privacy Statement applies to information collected by Rosepac Capital Pty Ltd and its related bodies corporate.

We are committed to protecting your privacy.

This policy explains how we collect, use, and manage your personal information. a. Information provided by you in connection with your application for, or inquiry regarding, our products or services, including but not limited to:

  •  social security eligibility status;

  •  dependent and family obligations;

  •  and requisite identification documentation;

 

   b. Your financial objectives, investment preferences, risk tolerance parameters, and related financial planning               requirements;

   c. Financial data pertaining to your current financial position, creditworthiness assessments, and information                 derived from credit bureau reports and investigations conducted with your express written authorization;

   d. All correspondence, communications, and documentation exchanged between our organization and your                 designated financial advisor, mortgage broker, or other authorized representatives; and

   e. Transaction records, account activity, and product utilization data relating to any current or former products or           services maintained with our organization.

In some circumstances, we are compelled by operation of law to collect prescribed information in accordance with statutory and regulatory obligations imposed upon our business operations. In particular, the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) imposes mandatory obligations upon us to collect personal information from investment and mortgage applicants for the purposes of conducting requisite identity verification procedures.

 

If you do not provide us with the personal information described above, we may not be able to engage with you, either in the way we ordinarily do or at all.  

Rosepac Capital collects your personal information in a number of ways including:

  •  directly from you, such as when you provide the information by phone, email, online or paper application form or face-to-face interview; and

  •  from third parties such as credit reporting agencies, other credit providers or from your broker / representative.

3. Purposes for collecting, holding, using and disclosing personal information

We will collect only such personal information as is reasonably necessary for, or directly related to, the performance of our statutory functions and business activities. We collect, retain, utilize, and disclose your personal information for the following lawful purposes:

a. identifying and verifying the applicants’ identify and conducting appropriate due diligence procedures;

b. assessing and determining the applicants’ requirements and suitability;

c. checking and ensuring that the information we collect and hold about applicants is accurate, complete and current;

d. facilitating us to manage, train and develop our employees and representatives;

e. administration and resolution of complaints and disputes;

f. providing clients with the products or services they have requested;

g. protecting individuals and ourselves from error, omissions, and fraudulent activities;

h. compliance with applicable regulatory obligations and requirements;

i. providing products and services to individuals and sending communications requested by an individual;

j. answering enquiries and providing information or advice about existing and new products or services;

k. conducting business processing functions including providing personal information to our related bodies corporate, contractors, service providers or other third parties;

l. administrative, marketing (including direct marketing), strategic planning, product or service development, quality assurance, and research purposes for our organization and our contractors and service providers;

4. Disclosure of personal information

Rosepac Capital may disclose your personal information subjects to the following parties and for the following purposes:

a. Personal information may be disclosed to finance brokers, mortgage managers, and other intermediaries who provide assistance in the delivery of our products and services to the data subject.

b. Disclosure may occur to financial consultants, chartered accountants, legal practitioners, and professional advisors engaged by the Company in the ordinary course of business.

c. In connection with investment applications, personal information may be disclosed to financial advisors, authorized representatives, guarantors, and co-applicants as necessary for the processing and administration of such applications.

d. The Company reserves the right to disclose personal information to any relevant industry body, tribunal, court of competent jurisdiction, or other regulatory authority in connection with any complaint, investigation, or proceeding regarding the approval, administration, or management of loans or other financial products, including circumstances where complaints are lodged against the Company or associated lending institutions.

e. Disclosure may occur to corporate affiliates and service providers; including Related bodies corporate of the Company; independent contractors and third-party service providers engaged for website operations, business administration, and service delivery; technology service providers including web hosting providers, IT systems administrators, electronic network administrators; administrative service providers including mailing houses, courier services, payment processors, and data entry service providers.

f. Personal information shall be disclosed to government agencies, regulatory bodies, and other organizations as required or authorized under applicable law, regulation, or legal process.

5. Third Party Access to Personal Information

Rosepac Capital may engage external service providers to perform specific functions including mailing services, settlement operations, banking transactions, and identity verification. Personal information disclosed to such providers is limited to information necessary for service delivery, and all service agreements contain strict confidentiality provisions binding third-party providers. Personal information may also be disclosed to investors of Rosepac Capital to facilitate the provision of products and services.

 

Where authorized, Rosepac Capital may obtain personal information from, or disclose personal information to, credit reporting agencies for the purpose of conducting credit assessments.

Rosepac Capita may use your personal information for direct marketing purposes. If you do not wish to receive direct marketing communications from us or from our related organisations, you may submit a request via email. We will respond to your request as soon as practicable.

All personal information is stored on secure servers located within Australia and protected through technical and organizational security controls, and access restrictions to ensure the confidentiality, integrity, and availability of personal data.
